O-1 Visa Lawyer in Austin, Texas
The O-1 is a temporary work visa for people with extraordinary ability or achievement in their field. An O-1 visa lawyer reads your record first and tells you whether it meets the standard USCIS applies, because the petition is built out of evidence you either have or do not.

The O-1 is a temporary work visa, not a green card. It can run alongside a permanent application, and the self-petition green card routes are a separate conversation.

A Visa for a Documented Record
The O-1 is for people who can show extraordinary ability or achievement in their field. It splits in two: O-1A for the sciences, education, business and athletics, and O-1B for the arts and for film and television. The two are assessed against different criteria, and USCIS publishes both sets.
What makes the O-1 unusual among work visas is that it is decided almost entirely on a documented record rather than on a job description. The petition is an argument about what you have already done, evidenced by things that exist independently of you: awards, published work, press coverage, the roles you have held, what you have been paid relative to others in your field.
That has a practical consequence. If the record exists, the case is largely a matter of assembling it properly. If it does not, no amount of drafting will manufacture it, and the honest advice is to say so and talk about what would change that. This is the category where a candid assessment saves the most money.
- O-1A covers the sciences, education, business and athletics
- O-1B covers the arts, and film and television, on different criteria
- It is decided on evidence of past achievement, not on a job title
- USCIS publishes the criteria for each variant and the number that must be met
Who Petitions, and the Route Most People Miss
The O-1 needs a petitioner, and that is where founders, freelancers and artists usually assume they are stuck. They often are not.
An Employer Petitions
- The usual route: a U.S. employer files the petition for you
- The petition is tied to that employer and to the work described in it
- Changing employer generally means a new petition, not a transfer
- The employer has obligations of its own in the filing
An Agent Petitions
- A U.S. agent can petition, which is the route a lot of people do not know exists
- It suits people with multiple engagements rather than one employer
- It is common in the arts and increasingly relevant to founders and consultants
- USCIS sets what an agent petition has to include, and it is more than a covering letter
What a Petition Is Built From
USCIS publishes the criteria and how many must be satisfied, and they differ between O-1A and O-1B. In practice the evidence tends to come from these four places.
Recognition by Others
Awards, prizes, and membership of bodies that require outstanding achievement of their members. Independent recognition weighs more than internal recognition.
A Published Record
Your own published work, and other people’s published work about you. Trade press counts, and so does scholarly citation, in the terms of your own field.
The Roles You Have Held
Critical or leading roles for organisations with a distinguished reputation, and judging the work of others in your field.
Commercial Evidence
What you have been paid relative to others doing similar work, and commercial success where your field measures it.
How a Case Runs
Five stages. The first is the one that decides the outcome, and it happens before anybody drafts anything.
The Assessment
We read the record against the criteria USCIS applies to your variant, and give you a straight answer about whether it holds up. This is the whole value of an attorney on an O-1.
UsAssembling the Evidence
Gathering what exists and identifying what is missing. Letters, publication records, contracts, press, pay evidence, and the consultation from a peer group where one is required.
You and usThe Petition
Filed by your employer or your agent, with the evidence and the argument that ties it to the criteria.
UsPremium Processing, Where You Want It
Available for these petitions at a fee USCIS publishes and sets. Whether it is worth it depends on your timing.
UsThe Visa, or a Change of Status
Once approved, you apply at a consulate abroad, or seek a change of status if you are already lawfully in the United States.
You, with usThe O-1 question is always the same one: does the record actually meet the standard.
Since 2010, the work has mostly been reading a record against a published standard.
What People Say After the Case Closes
Every case is different. Past results and timelines do not guarantee a similar outcome.
The O-1 and the Permanent Alternatives
People with an O-1 record often qualify for a green card route as well, and running both is common. These are the differences that decide the order.
| O-1 visa | EB-1A green card | EB-2 national interest waiver | |
|---|---|---|---|
| What it is | A temporary work visa | Permanent residence | Permanent residence |
| The standard | Extraordinary ability or achievement | Extraordinary ability, assessed for permanence | Advanced degree or exceptional ability, plus a national interest argument |
| Needs a petitioner | Yes, an employer or an agent | No, you may self-petition | No, you may self-petition |
| Tied to the work described | Yes | No, once the card is issued | No, once the card is issued |
| Numerically limited | No | Yes, and usually less pressured | Yes, and country of birth matters |
| Often used | To get here and start working | To stay permanently | To stay permanently, on a different argument |
The common sequence is an O-1 first, because it can be quicker, then a permanent petition while you are here and working. Which permanent route fits is a separate assessment of the same record against a different standard.

A Straight Answer About Your Record
On an O-1 the most valuable thing an attorney does is refuse a case. The petition is expensive in time and evidence, and a record that does not meet the standard does not become one through better drafting.
Pablo Nossa has practiced immigration law and nothing else since 2010, from offices in Austin and Houston. He takes the consultation himself and gives clients his cell number, and he reads the record himself rather than passing it to somebody else to summarise.
The firm tells you plainly when it does not see a viable route. On an O-1 that means telling somebody their record is not there yet and what would change that, which is a more useful conversation than an optimistic one.
